Self-certification of regulatory status, including small business size, set-aside eligibility, tax compliance, foreign ownership, and other federal program participation.
When This Clause Applies
Required in all FAR Part 12 commercial item solicitations. Annual reps are made in SAM.gov; solicitation-specific reps may also be required.
What This Means for Contractors
Most reps are completed once a year via SAM.gov and incorporated by reference. False representations can trigger False Claims Act liability and debarment. Solicitation-specific certifications (e.g., 'taxpayer identification number') override the annual SAM rep for that solicitation.
Common Pitfalls
- 1Letting SAM.gov registration lapse — your reps are no longer current
- 2Misrepresenting small business size for the solicitation's NAICS
- 3Not updating reps after a merger, acquisition, or change in ownership
- 4Failing to read the solicitation-specific certifications that override SAM
