Aliff Solutions FZC ("Aliff Solutions," "we," "us," or "our"), registered in Ras Al Khaimah, United Arab Emirates, respects the intellectual property rights of others and expects users of our platform to do the same. This policy outlines the procedures for reporting alleged copyright infringement on the Aliff Labs platform in accordance with the Digital Millennium Copyright Act (DMCA), 17 U.S.C. § 512.

2. Filing a DMCA Takedown Notice

If you believe that content available on or through the Aliff Labs platform infringes your copyright, you may submit a written notification to our designated agent containing the following information:

  • Identification of the copyrighted work: A description of the copyrighted work you claim has been infringed, or, if multiple copyrighted works are covered by a single notification, a representative list of such works.
  • Identification of the infringing material: A description of the material you claim is infringing and its location on the platform, with enough detail for us to locate it (e.g., URL or screenshot).
  • Your contact information: Your name, mailing address, telephone number, and email address.
  • Good faith statement: A statement that you have a good faith belief that the use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
  • Accuracy statement: A statement, made under penalty of perjury, that the information in your notification is accurate and that you are the copyright owner or are authorized to act on behalf of the copyright owner.
  • Signature: A physical or electronic signature of the copyright owner or a person authorized to act on their behalf.

3. Counter-Notification

If you believe that material you posted on the platform was removed or access to it was disabled by mistake or misidentification, you may file a counter-notification with our designated agent containing the following:

  • Identification of the removed material: A description of the material that was removed or to which access was disabled and the location at which the material appeared before it was removed or disabled.
  • Good faith statement: A statement, under penalty of perjury, that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification.
  • Consent to jurisdiction: A statement that you consent to the jurisdiction of the federal court for the judicial district in which your address is located, or if outside the United States, the jurisdiction of the courts of Ras Al Khaimah, UAE, and that you will accept service of process from the person who provided the original notification.
  • Your contact information: Your name, address, telephone number, and email address.
  • Signature: Your physical or electronic signature.

Upon receipt of a valid counter-notification, we will promptly forward a copy to the original complainant. If the complainant does not notify us within 10 business days that they have filed an action seeking a court order to restrain the allegedly infringing activity, we will restore the removed material within 10 to 14 business days after receiving the counter-notification.

4. Repeat Infringers

In accordance with the DMCA, we will terminate the accounts of users who are determined to be repeat infringers in appropriate circumstances. We may also, in our sole discretion, limit access to the platform or terminate the account of any user who infringes the intellectual property rights of others, regardless of whether there is any repeat infringement.

5. Misrepresentation Warning

Please be aware that under 17 U.S.C. § 512(f), any person who knowingly materially misrepresents that material or activity is infringing, or that material or activity was removed or disabled by mistake or misidentification, may be subject to liability for damages, including costs and attorneys' fees. Please ensure that your DMCA notification or counter-notification is accurate before submitting it.
