FAR 52.246-2 — Inspection of Supplies — Fixed-Price
Establishes the government's right to inspect supplies before and after acceptance, and the contractor's obligation to replace, repair, or refund for nonconforming supplies.
When This Clause Applies
Required in fixed-price supply contracts (non-commercial-item).
What This Means for Contractors
Government can inspect at any time, including at the contractor's facility. Acceptance generally bars later rejection except for latent defects, fraud, or gross mistakes amounting to fraud. Nonconforming supplies must be replaced, repaired, or refunded at contractor cost.
Common Pitfalls
- 1Not documenting inspection results from the contractor side
- 2Treating acceptance as final without recognizing latent defect exception
- 3Failing to invoke Disputes for unreasonable rejection
