FAR 52.244-6 — Subcontracts for Commercial Products and Commercial Services
Requires primes to use FAR Part 12 commercial item procedures when subcontracting for commercial items, with limited flow-down of FAR requirements.
When This Clause Applies
Required in non-commercial item prime contracts where the prime subcontracts for commercial items.
What This Means for Contractors
Primes have streamlined flow-down requirements when buying commercial items from subs. Only a specific list of clauses must flow down (CAS, kickbacks, sanctions, etc.); most prime contract clauses do not. This reduces sub administrative burden.
Common Pitfalls
- 1Flowing down too many clauses (creates unnecessary sub burden)
- 2Failing to flow down the required clauses
- 3Not recognizing when an item qualifies as commercial
