FAR 52.225-1 — Buy American — Supplies
Implements the Buy American Act preference for domestic end products in federal acquisitions over the micro-purchase threshold.
When This Clause Applies
Required in supply contracts above the micro-purchase threshold. Various waivers apply for products not domestically available, public interest waivers, and trade agreement applicability.
What This Means for Contractors
Offerors must certify the origin of supplies. Domestic end products receive a price preference (50% over foreign for civilian, 50% for non-DoD, 50% for DoD with specific exceptions for qualifying countries). 2022 Build America Buy America (BABA) Act tightened domestic content requirements for federally funded infrastructure.
