FAR 52.211-15Defense Priority and Allocation Requirements

Establishes priority ratings (DO and DX) for defense and critical infrastructure contracts under the Defense Production Act, requiring contractors to give priority to rated orders.

When This Clause Applies

Required in contracts with priority ratings under the Defense Priorities and Allocations System (DPAS).

What This Means for Contractors

Contractors must accept and prioritize rated orders ahead of unrated orders. DX orders rank above DO orders; both rank above unrated. Failure to honor priority rating can trigger criminal penalties under the Defense Production Act. Subcontractor flow-down is mandatory.

Common Pitfalls

  • 1Treating priority rating as suggestion rather than legal requirement
  • 2Failing to flow priority to subcontractors
  • 3Inadequate scheduling systems to enforce priority
