FAR 52.227-17 — Rights in Data — Special Works
Default IP clause for 'special works' contracts (creative, audio-visual, training, or educational materials) — the government typically receives unlimited rights including copyright assignment.
When This Clause Applies
Used in contracts for the production of audiovisual, training, or other special works. Contracting officer determines applicability.
What This Means for Contractors
By default, the contractor must assign copyright in special works to the government. Contractor IP and pre-existing material can be carved out via the Assertions table at proposal. Failure to assert is a permanent waiver — the government keeps all rights.
