FAR 52.215-20 — Requirements for Certified Cost or Pricing Data
Requires offerors to submit certified cost or pricing data on negotiated contracts over the TINA threshold (currently $2 million) when no exception applies.
When This Clause Applies
Required for negotiated procurements over the TINA threshold ($2M as of 2024), except for commercial items, adequate price competition, and prices set by law/regulation.
What This Means for Contractors
Offerors must submit Form SF 1411 cost data showing direct labor, materials, ODCs, indirects, and profit. Data must be 'accurate, complete, and current' as of the agreement date. Defective pricing (false certification) is False Claims Act-eligible and triggers contract price reductions.
Common Pitfalls
- 1Submitting outdated cost data — TINA requires data current as of agreement date
- 2Not flowing TINA requirements to large subcontractors
- 3Missing the threshold by aggregating related orders
- 4Confusing 'cost or pricing data' with 'data other than certified cost or pricing data'
